Underwater Video Camera Competition Terms and Conditions
HOW TO ENTER
To enter, the BioGuard® Underwater Movie Camera Competition (Promotion), entrants must purchase a BioGuard® product from a BioGuard® Approved Retail Outlet, and then visit www.bioguard.com.au/moviecamera to upload a fun, creative photo of their family and/or friends enjoying their pool or spa, input the requested details and submit the fully completed electronic entry form. Entry in the Promotion is deemed full acceptance of these Terms and Conditions.

Australia
- Promotion commences 01/09/11 and entries close 5.00pm CST (for online entries) 31/03/12.
- Promotion is open to Australian residents only.
- All information on how to enter and prizes form part of these Terms and Conditions.
- Employees (and their immediate families) of the Promoter, participating BioGuard® and/or BioGuard Poolside® retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- Entrants under 18 years of age must have the consent of their parent or guardian to enter.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Any determination by the Promoter as to eligibility and validity of entries is final and no correspondence will be entered into.
- Incomplete, indecipherable or illegible entries or entries containing corrupted files will be deemed invalid.
- There are 200 Kodak PlaySport Zx5 underwater video cameras to be won. Only one winner will be selected from each BioGuard® Approved Retail Outlet and every winner will receive a Kodak PlaySport Zx5 underwater video camera. Each camera is valued at AU$250.00. Total prize pool is AU$50,000.00.
- Participants are required to purchase any BioGuard® product from one of 200 BioGuard® Approved Retail Outlets in Australia to qualify for entry into the Promotion. Participants can then upload to the BioGuard® website a photograph of their family and/or friends enjoying their pool or spa and complete the electronic entry form.
- The object of the Promotion is to provide the most creative photograph that is symbolic of fun in a swimming pool or spa.
- The Promoter will select the judging panel for the Promotion in exercise of its sole discretion. All photograph entries will be judged by the judging panel individually on their merits for its fun and creativity. The judging panel shall determine one winner from each BioGuard® Approved Retail Outlet. The judges' decision is final and no correspondence will be entered into.
- The Promotion is a game of skill. Chance plays no part in determining the winners.
- BioGuard supports responsible behaviour and does not encourage reckless, dangerous or illicit behaviour.
- Winners shall be notified by mail, electronic mail or telephone; and names published in public notices section of The Australian on 11/06/2012. The details of winners may also be displayed at BioGuard® Approved Retail Outlets from 11/06/2012.
- Multiple entries by any one entrant are acceptable, provided that each entry is in relation to a different photograph, and only entries completed in full are valid.
- Promoter takes no responsibility for lost or late entries. No correspondence will be entered into.
- Prizes cannot be exchanged or redeemed for cash. The Promoter reserves the right to request that prize winners provide proof of identity or proof of their eligibility to enter the Promotion in order to claim their prize.
- Entrants agree and hereby consent that they may be filmed, photographed and/or interviewed and consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- Any cost associated with accessing the website for the purpose of entering the Promotion is the entrant’s responsibility and is dependent on the Internet service provider used.
- The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or in connection with the Promotion, including, but not limited to, where arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late or lost (whether or not after their receipt by the Promoter); (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize. - As a condition of accepting any prize, the relevant prize winner must sign any legal documentation as and in the form required by the Promoter in their absolute discretion, including but not limited to a legal release and indemnity form.
- The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending mail, electronic messages or telephoning the entrant. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Entrants assign all of their right, title and interest to all images, including without limitation copyright, and the Promoter retains the rights to all images, including without limitation copyright. Entrants represent to the Promoter that the entrant has the right, title and interest to all images, including without limitation copyright, and has the ability to effect the forgoing assignment. Entrants acknowledge that the Promoter is entitled to use the image(s) for any purpose whatsoever, including but not limited to marketing, advertising, point-of-sale material and all other printed and electronic media, and consent in favour of the Promoter to the performance of any act or omission which would otherwise amount to an infringement of any moral right of the entrant.
